  • Terms of Use – Bayside Parking

    By accessing or using any parking facilities, yards, or services provided by Bayside Parking ("we", "us", or "our"), you ("you", "your", or "customer") agree to the following Terms of Use. These terms apply to all individuals, businesses, or entities using any Bayside Parking location or facility for the parking or storage of vehicles, equipment, or other property.

    Please read these terms carefully before using our facilities.


    1. Use of Facilities

    By parking your vehicle or storing your equipment at any Bayside Parking location, you acknowledge and agree that:

    • You are using the premises at your own risk.

    • You accept full responsibility for any loss, damage, theft, or incident that may occur while on our premises.

    • Your use of the parking or storage area does not constitute a bailment or custodial arrangement.

    • Bayside Parking does not take possession of or assume responsibility for your vehicle, equipment, or any property stored.


    2. Limitation of Liability

    Bayside Parking and its directors, employees, agents, contractors, or affiliates will not be liable to you or any third party for any loss, damage, destruction, or theft of your vehicle, equipment, or any other personal or commercial property, including but not limited to:

    • Vandalism or malicious acts

    • Fire, storm, hail, flood, or other natural disasters

    • Theft, burglary, or attempted theft

    • Collision or accidental damage by third parties

    • Electrical faults, mechanical failures, or environmental hazards

    • Acts of God or any unforeseen or uncontrollable event

    You expressly agree to release, indemnify, and hold harmless Bayside Parking from any and all claims, demands, losses, costs, or expenses arising from or related to your use of our facilities.


    3. No Insurance Provided

    Bayside Parking does not provide insurance for any vehicles, machinery, equipment, or other items stored or parked at our sites. It is your sole responsibility to:

    • Maintain appropriate insurance coverage for your property

    • Ensure your property is secured or immobilized

    • Remove valuables or sensitive items before leaving your vehicle or equipment onsite

    We recommend all users carry comprehensive insurance to cover potential risks while using our premises.


    4. Security and Surveillance

    While some of our sites may have surveillance systems or access control features in place, Bayside Parking does not guarantee the security of your property. Any such features are for deterrent purposes only and should not be relied upon as a guarantee of safety.


    5. Compliance and Conduct

    You agree to:

    • Operate your vehicles or machinery safely while on the premises

    • Obey all posted signs, speed limits, and staff instructions

    • Not block access ways, entry gates, or emergency routes

    • Not conduct repairs, refueling, or hazardous activities onsite unless specifically approved in writing

    We reserve the right to refuse entry or terminate access to any customer who fails to comply with these terms or engages in unsafe or unlawful behavior.


    6. Access Hours and Availability

    Unless otherwise agreed in writing, access to our facilities is subject to the designated operating hours or by arrangement only. We reserve the right to:

    • Change access hours

    • Temporarily restrict entry due to maintenance or safety reasons

    • Relocate parked vehicles or stored equipment in emergencies or for operational purposes


    7. Fees and Payment

    All parking or yard usage must be paid in full in accordance with our pricing schedule or agreed lease terms. Failure to pay may result in suspension of access and removal of vehicles or equipment from the site at your expense.


    8. Termination of Use

    Bayside Parking reserves the right to terminate your use of any of our facilities at any time, without prior notice, in the event of:

    • Breach of these terms

    • Unsafe or illegal behavior

    • Non-payment of fees

    • Site redevelopment or operational changes

    In such cases, you must promptly remove all vehicles, equipment, and property from the premises. Failure to do so may result in removal at your cost and legal action to recover associated fees.


    9. Indemnity

    You agree to indemnify and hold Bayside Parking harmless from and against any and all claims, actions, losses, damages, liabilities, costs, or expenses (including legal costs) arising out of or related to:

    • Your use of our facilities

    • Damage caused to property or injury to persons by your vehicle, equipment, or personnel

    • Breach of these terms

    • Any third-party claim resulting from your actions


    10. No Guarantee of Space

    Use of our parking or storage facilities is subject to availability. We do not guarantee that space will be available at any given time unless confirmed by reservation or written agreement.


    11. Modifications to Terms

    Bayside Parking reserves the right to update or modify these Terms of Use at any time. Updated versions will be posted onsite or provided via email. Continued use of our facilities after such updates constitutes acceptance of the revised terms.


    12. Governing Law

    These terms shall be governed by and construed in accordance with the laws of the State of New South Wales. Any disputes arising from the use of our services shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.


    13. Acceptance

    By entering our premises, parking your vehicle, or storing equipment at any Bayside Parking location, you acknowledge that you have read, understood, and agreed to these Terms of Use. If you do not agree, do not use our services or enter our property.
